Litigation is expensive, stressful, time consuming and often produces a result that does not satisfy the parties needs and interests.

Alternative Dispute Resolution (ADR) refers to procedures for settling disputes by means other than litigation such as Mediation, Arbitration, and Early Case Evaluation.

WHAT IS MEDIATION?

Mediation is a private, informal dispute resolution process in which a neutral third person, the mediator, helps the disputing parties reach an agreement.  The mediator has no power to impose a decision on the parties and the parties retain the decision- making power.  The results meet the parties needs and interests and produce a win-win agreement.

WHAT IS ARBITRATION?

Arbitration is a process of dispute resolution in which a neutral third party, the arbitrator, renders a decision after a hearing at which both parties have an opportunity to be heard.  At the hearing, the parties and their attorneys present evidence similar to a trial but the rules of evidence are less formal.  The arbitrator has the power to render a binding decision.

WHAT IS EARLY CASE EVALUATION?

Early Case Evaluation is an alternative dispute resolution process where an attorney experienced in the subject matter of a particular case evaluates all sides of the case as presented by the parties and offers an assessment of the case.  The case evaluator will discuss settlement options with the parties as well.
